Laura Cole revealed in a local news report in the Sacramento area that Charles Schmidt, the wrestling fan who was attacked by CM Punk during Monday’s Raw, is considering hiring an attorney for a possible lawsuit following the incident.

The news report noted that local police are not following up on the incident because at the time the police report was filed, Schmidt said he did not want to press charges. Tuesday, Cole reached out to Schmidt, who noted he is considering a suit.

Schmidt said in a post-Raw interview that he did not touch Punk before Punk struck him, was “a little upset with Punk,” and was mainly “just shocked about how his night of entertainment ended with him getting smacked on live TV.”

    This would make him look like a retarded cowardly pussy, but maybe being a coward and a liar is a noble act in his family, this fan already said he wouldn’t press charges, now he’s just contradicting himself.

    I have seen it from every angle. I know he didn’t purposely hit punk. However, he did make contact to the back of Punk’s head, probably do to that little idiot that was pushing punk. All I am saying is he did touch Punk and it’s no wonder Punk went after him, it was the last thing he felt on the back of his head. The guy needs to own up to the fact that he did bump Punk, and quit trying to act like there was NO reason Punk would have thought it was him.

    Watch the video again, that dude didn’t touch him. It was the guy behind him who flips off the camera right before he slaps him. He was very stealthy about it, then bragged about it on the internet afterward that he will never get caught…. The dude with the glasses is innocent. Innocent, I say!!!

    All I would want is tickets for front row ring-side seats to any show for life! Also future wrestling games including pre-order content.

    Anyone who thinks a waiver on a ticket has any real legal value is fooling themselves. Both Punk and the WWE would be liable. Punk hit the wrong guy, period. A lawsuit would end in a settlement.

    I’m a fan of Punk in the ring and on the show but I’m not sure why everyone is rushing to his defense on this one. He pushed a guy in the face who appeared to do nothing wrong. He screwed up. He didn’t see who hit him and just took a guess, which is a bad idea for someone in his position. This isn’t an idie show, it’s big business. He put his employer at risk.

    I’m sure they’ve done it already, but they need to find this guy and make him happy. They need to offer him a package that he can’t turn down and keep this out of the courts. They also need to find the guy who DID hit Punk and press charges, in order to make even idiots understand that it’s a bad, bad idea to assault WWE employees while they are working.

    He did touch Punk, a couple times, once in the back of the head before Punk rocked him. He is a liar.

    Seeing as he is not pressing criminal charges against Punk, this is going to go absolutely no where.

    He admitted that he wasn’t really harmed (quoted as having felt Punks wrist tape grazing his face).

    Also all WWE tickets have a waiver on them (much like Hockey games in case of stray pucks or sticks), that reads the following:

    “THE HOLDER OF THIS TICKET ACKNOWLEDGES AND ASSUMES ALL RISKS OF PERSONAL INJURY AND ALL OTHER HAZARDS AND DANGERS ARISING FROM OR RELATED IN ANY WAY TO THE EVENT (INCLUDING, WITHOUT LIMITATION, RISKS OF PERSONAL INJURY, PROPERTY LOSS AND/OR DAMAGE OR OTHER HAZARDS), ARISING OR RESULTING FROM ANY CAUSE WHATSOEVER (INCLUDING, WITHOUT LIMITATION, BY PLAYERS, SPECTATORS OR OBJECTS AND OTHER INHERENT RISKS INCIDENTAL TO THE EVENT AND NEGLIGENCE) AND WHETHER OCCURRING PRIOR TO, DURING OR AFTER THE EVENT.”

    He would be much better of asking for Wrestlemania tickets or something, as a lawsuit could be costly and ineffective.

    Honestly, I wouldn’t sue. I would just ask for a visit to WWE Headquarters, a compensated round-trip fare to NYC and 3 maximum tickets to Wrestlemania 29.
