WWE planning on using Matt Hardy’s ‘Broken’ gimmick

According to a report from F4WOnline, the WWE is planning on using Matt Hardy’s ‘Broken’ gimmick. On a recent edition of Wrestling Observer Radio, Dave Meltzer stated that the WWE and Impact Wrestling are finalizing a deal that will allow Matt to use the ‘Broken’ character on television.

Impact has been claiming ownership of the gimmick since The Hardys’ departure from the company, recently adding trademark symbols to their YouTube channel on videos that contain references to the gimmick. A cease and desist order was also sent to pay-per-view (PPV) providers who aired the Ring Of Honor (ROH) 15th Anniversary PPV in which The Hardys appeared on, claiming intellectual property over the gimmick.

Hardy has been using the gimmick’s manerisms on WWE TV as of late, and has also been switching his Twitter handle fromĀ “#BROKEN”, “#Version1” and “#Mattitude.”

    why would TNA show wrestlers that they are never allowed to graduate from TNA to WWE intact? hows that gonna bring out the best in the wrestlers you can bring in

    Yeah I can see them doing that. I’m sure that Vince has big plans for that character and whatever litigation costs that my be there for having their laywers back Matt probably would be off-set from potential future revenue regarding the character.

    I do want to be clear that there is a measure of hypocrisy in this. WWE in effect did the same thing to Cody Rhodes despite the fact that his late father Virgil Runnels a.k.a. Dusty Rhodes had used the name LONG before he wrestled in the WWF or even the WWWF.

    Yeah, they certainly would not be “negotiating” with Anthem. They might be throwing their legal team behind Matt to help him win the case, but negotiating with the guys he is contesting ownership with is not something that would be done as that would undermine Matt’s claim as it would be seen as WWE admitting they believe Anthem has ownership of the gimmick.

    As for Anthem sticking a trademark symbol to their videos. Unless they have a “registered” trademark, then that is pointless. I could claim ownership of The Terminator films and post them on youtube with a TM logo if I want, but that does not mean I have a trademark.
    Filing a trademark is one thing, but that does not mean they have the trademark yet.
    Plus, all that trademark logo could mean is that stuff like Impact being mentioned is trademarked.

    Thanks for stating the obvious. I know that WWE cannot use the character while the IP is in the dispute. My point was that why would WWE be involved with this issue at all when it is an internal matter between Hardy and Anthem, and it has not been proven that Anthem has any legal claim to the IP in the first place?

    If they DO own the character there is absolutely *ahem* NO CHANCE IN HELL (pun intended) they are going to negotiate any deal to give WWE use of the character. The whole reason they did this ‘cease and desist’ in the first place was to STOP WWE from cashing in on the character.

    I don’t think Matt Hardy is so obtuse to think he owns a character where there is documentation that HE SIGNED saying that any creations or characters belong to Impact Wrestling. Also, WWE is smart enough to tell Matt that if that is the case, you don’t have a leg to stand on and we aren’t messing with that.

    So I think that either Anthem has no leverage and WWE is just waiting for the right moment to when they can unveil the character, OR all of this is a ruse and all parities involved are in on this to garner ratings for themselves.

    Because as long as the suit is going on, WWE can’t use the character. And I’m sure Vince’s lawyers are a lot better than Matt’s.

    Matt Hardy claims that the ‘Broken’ Matt Hardy gimmick is HIS sole intellectual property and is disputing that claim with Impact and Anthem. He’s even filed for trademarks on the name which again would make the gimmick HIS property and not the company he works for.

    Why would WWE be “negotiating” with Anthem and Impact Wrestling on rights to use a intellectual property which as best ownership is in flux with pending litigation, at worst is NOT the property of Impact Wrestling but of Matt Hardy? Also, why would WWE interject themselves into a legal dispute that is between Matt Hardy and Anthem? Just sayin.’
