Cain Velasquez, who is presently out on bail, recently appeared in court along with his 5-year-old son in the Harry Goularte molestation case. The accused, Goularte, has been charged with sexually assaulting Velasquez’s son at a daycare facility when he was four years old. Velasquez, a former UFC fighter, faces charges of attempted murder for shooting at Goularte’s vehicle during a dramatic chase last February.
During a preliminary hearing on Monday, Cain Jr. testified before a room filled with Goularte’s family. To protect the child, prosecutors set up a box so that he did not have to face the alleged offender, who was seated 25 feet away. Cain Jr. was also allowed to color in a Pokemon coloring book while on the stand as the Deputy District Attorney, Robert Philbrook, attempted to extract binary answers from him.
With the help of a sketch of a stick figure drawn by Philbrook, Cain Jr. eventually revealed that Goularte had touched him in his private area with his hand in a bathroom at the daycare center. Although Velasquez’s wife also took the stand, the former UFC champion was not permitted to testify.
On cross-examination, the defendant’s attorney, Steve Defilippis, claimed that the child’s testimony was coached and inconsistent.
Monday’s preliminary hearing was the first time that Cain Velasquez’s son publicly implicated Harry Goularte, who pleaded not guilty last June.
After a full day of hearings at the Santa Clara County (Calif.) court that included the testimony of Goularte’s mother, Patricia Bender, Judge Javier Alcala decided that the accused should go to trial. Goularte is due back in court for his trial on March 13.
