Former President Donald Trump has called for the arrest of special counsel Jack Smith after prosecutors admitted to discrepancies in the handling of evidence in Trump’s classified documents case. Trump took to Truth Social to express his outrage, accusing Smith of criminal behavior and labeling the case as an “Election Interference Scam” orchestrated by President Joe Biden and Smith.
The admission by Smith’s prosecutors that evidence is no longer in its original form contradicts earlier statements made to the court, where they had claimed only certain classified documents were removed and replaced with placeholders. This discrepancy has raised concerns among legal experts about potential evidence tampering and the integrity of the case.
John Malcolm, Vice President for the Heritage Foundation’s Institute for Constitutional Government, and Philip A. Holloway, a criminal defense attorney, both emphasized the seriousness of the situation, comparing it to tampering with DNA samples or smudging fingerprints.
Investigative reporter Julie Kelly further elaborated on the potential ramifications of the prosecutors’ actions, suggesting that their attempt to stage a “phony photo” using classified cover sheets may have led to inaccuracies in matching placeholders with the appropriate documents, which could jeopardize the entire case.
