According to Mediate, U.S. District Court Judge Tanya Chutkan has denied a motion from Donald Trump’s attorneys seeking to extend the deadline for responding to the prosecution’s protective order request. The protective order was requested by Special Counsel Jack Smith and his team, citing a Truth Social post from Trump as part of the basis for the request.
On Friday, Smith’s team filed a motion for the judge to issue the protective order, and on Saturday, Judge Chutkan ordered Trump’s team to respond by 5 pm on Monday. In response, Trump’s lawyers filed their own motion requesting the deadline be moved to Thursday, August 10, citing the late notice and lack of discussion from the government about the proposed order.
However, the prosecution opposed the request for a delay, stating that they want to provide discovery to the defendant and that the motion should be denied. Judge Chutkan ultimately denied Trump’s request for an extension, stating that the defendant may continue to confer with the government regarding the proposed protective order before or after the August 7 deadline. The court will review Trump’s response and, if included, his revised proposed protective order with modifications before deciding whether to schedule a hearing to discuss the order further.
MINUTE ORDER as to DONALD J. TRUMP: Defendant’s 11 Motion for Extension of Time is hereby DENIED. Defendant may continue to confer with the government regarding its proposed protective order before or after the August 7, 2023 5:00 PM deadline for his response. The court will determine whether to schedule a hearing to discuss the proposed protective order after reviewing Defendant’s response and, if included, his revised proposed protective order with modifications in redline.
