Special counsel Robert Hur is reportedly not anticipated to file charges in connection with the mishandling of classified documents linked to President Joe Biden. Sources close to the investigation informed CNN that Hur and his team, conducting a year-long probe, are in the process of compiling a detailed report. The report is expected to be critical of Biden and his staff for their handling of sensitive materials, providing significant detail about the findings. Although the team aims to complete the report by the end of the year, the timeline is subject to change.
Ian Sams, a spokesperson for the White House Counsel’s Office, has declined to comment on the matter. Hur was appointed in January to investigate after classified documents from Biden’s time as vice president were discovered at the Penn Biden Center in Washington, DC, and his Wilmington, Delaware, residence.
The Wall Street Journal initially reported that Hur is unlikely to bring a criminal case. Earlier reports from CNN suggested charges were improbable based on sources familiar with the investigators’ line of questioning, with no evident grand jury activity.
The decision not to pursue charges may face criticism from Donald Trump and his allies, who have drawn parallels between Hur’s investigation and that of special counsel Jack Smith. Smith brought charges against Trump earlier this year related to his handling of classified documents after leaving the White House.
Several key differences distinguish the two probes. Notably, the National Archives repeatedly attempted but failed to recover documents from Trump’s possession. At one point, the FBI secured a search warrant to search Trump’s Florida estate. In contrast, Biden’s attorneys promptly notified the National Archives of the materials found in his possession.
