On Monday, the Supreme Court announced that it would hear a case revolving around a man’s attempt to trademark a phrase mocking former President Donald Trump as “too small.” The Justice Department, surprisingly, is backing President Joe Biden’s once and possibly future rival in urging the court to reject the trademark application for the phrase “Trump too small” that a California man wants to use on T-shirts.

The case is set to be argued in the fall and is one of two disputes on the court’s upcoming docket that involve Trump or his businesses. Government officials argued that the phrase “Trump too small” could still be used, but not trademarked, since Trump had not given his consent for its use. However, a federal appeals court ruled that denying trademark registration violated the right to free speech.

In recent years, the Supreme Court has dealt with numerous Trump-related cases, including matters pertaining to Trump’s claims of election fraud in 2020 and his attempts to shield his tax records from Congress and prosecutors in New York. Despite this, the court doesn’t seem weary of Trump-related cases. Just last month, the justices agreed to hear another lawsuit related to Trump, this one stemming from disputes over the former Trump International Hotel in Washington.

What makes the current case unusual is the Biden administration’s support for Trump. The administration is defending the government officials’ decision to reject Steve Elster’s trademark request for the phrase “Trump too small.” Elster’s application references a memorable exchange during the 2016 presidential campaign between Trump and Florida Senator Marco Rubio, who criticized Trump’s hands as disproportionately small.
