Kaplan, who led the legal team securing an $83.3 million judgment against Trump for defaming E. Jean Carroll, revealed an incident during a different deposition where Trump used a coded expression that initially went over her head.
During the podcast, Kaplan recounted the deposition for a fraud trial, which concluded around 4:00 in the afternoon. As the proceedings ended, the other side immediately requested to go off the record. Trump then looked at Kaplan from across the table and said, “See you next Tuesday.”
Kaplan, unaware of the coded expression, responded innocently, stating that she would be back on Wednesday. Later, when discussing the incident with her colleagues in the car, they explained the meaning behind the expression, and Kaplan realized the potential provocation she had unwittingly avoided.
In the podcast exchange, Kaplan highlighted that Trump’s use of the coded expression was deliberate, resembling a teenage boy’s joke. Despite not understanding the reference at the time, Kaplan’s response appeared composed and polite, avoiding potential escalation had she known the meaning.

ROBBIE KAPLAN: Let me get you there. So with the the the fraud deposition we go through, we end about 4:00 in the afternoon, and, we come in the room and I say, I’m done asking questions. And I immediately hear from the other side. Off the record, off the record, off the record. So they must have planned it. And he looks at me from across the table and says, see you next Tuesday.
GEORGE CONWAY: For the second deposition. Was the deposition on a Tuesday, counsel.
ROBBIE KAPLAN: And well, no, no, I don’t think it was. We’ll look it up, but I don’t think it was. And I thank God had no idea what that meant. So I said to him, what are you talking about? I’m coming back on Wednesday. It’s literally it was an honest answer, I had no idea what he’s talking about. Then we get into the car.
SARAH LONGWELL: Did he respond? Wait. Did he laugh or something?
GEORGE CONWAY: But they said they see. They said he’s sort of like in a deliberate way, right?
ROBBIE KAPLAN: I mean yeah, yeah, yeah. He can I try you could tell he was like there was like a kind of a joke, again like teenage boys would come up with.
SARAH LONGWELL: Yeah, but that is a teenage boy level joke.
ROBBIE KAPLAN: Yeah. I wasn’t in on the joke, so I had no idea. Then we get into the car and my colleagues are like, Robbie, do you know what that means? And I’m like, no, what are you talking about? They tell me and I’m like, oh my God, thank God I didn’t know because had I known, I for sure would have gotten angry.
There’s no question I would’ve gotten angry and I did it because I didn’t know. So I was super polite and I looked like I was being above it all, which I wasn’t. I just did not know.
GEORGE CONWAY: So that’s just an amazing story!
