Hunter Biden has dropped his bid for a new trial after federal prosecutors criticized him for a “misunderstanding of appellate practice” and “failure to read” prior court orders. Convicted on June 11 of three counts related to lying about his drug addiction to obtain a firearm, Biden had filed for a new trial on June 24, claiming Judge Maryellen Noreika lacked jurisdiction due to pending rulings in his appeals case.
However, prosecutors from special counsel David Weiss’ office noted in their response that the Third Circuit Court of Appeals had already authorized Noreika to preside over the case. Prosecutor Derek Hines highlighted that the Third Circuit had dismissed both of Biden’s appeals and denied his petition for rehearing before the trial commenced.
“Both dismissal orders are plainly stamped ‘Issued in Lieu of Mandate’ and provide no basis for this Court to reconsider its earlier rulings with respect to jurisdiction when non-appealable orders are appealed,” Hines wrote.
Following this, Biden’s lead defense attorney, Abbe Lowell, acknowledged the oversight in a brief response: “As it appears that the Third Circuit views issuing a certified order ‘in lieu’ of a mandate as compliant with … procedure for shortening the time for issuance of a mandate, Mr. Biden withdraws his motion.”
Biden, who was convicted for lying about his drug addiction to obtain a firearm, faces up to 25 years in prison. Despite this, he is unlikely to receive such a severe sentence under federal guidelines. Sentencing has yet to be scheduled by Judge Noreika.
A recent Associated Press-NORC Center for Public Affairs Research poll found that 60% of Americans, including 59% of Democrats, agreed with the verdict in Biden’s Delaware trial, with nearly half also believing he deserved a prison sentence.
Hunter Biden is also set to go on trial in Los Angeles on September 5 for allegedly evading $1.4 million in taxes from 2016 to 2019. His earlier appeal in this case to the Ninth Circuit Court of Appeals, which prosecutors called a “stunt to delay his trial,” was rejected in mid-May.
