Donald Trump has a relief as the weekend is upon us. The former president got a gag order on Monday which he heavily talked about during his meetings post the order. The order even caused concerns for Trump who had to keep his voice under control and his posts under limit to avoid getting a penalty.
While Trump got a penalty for another gag order, it looks like Federal District Judge Tanya Chutkan is going soft on the former president. She ruled a gag order on Monday, but has temporarily put a stay on it after Trump’s attorneys filed in the court about some recent turn of events.
Notably, Jack Smith in September filed a motion for a limited gag order, and then filed a new motion to support the gag order. This came after the infamous remarks from Trump about General Mark Milley.

Trump’s attorneys understood the situation and drafted details which state otherwise. These details state that even though the threats were followed by the statements from the former president, there wasn’t proof that the statements caused the threats.
In entering the Gag Order, the Court relied heavily on the anticipated reactions of unidentified, independent third parties to President Trump’s speech. The Court found that “when Defendant has publicly attacked individuals, including on matters related to this case, those individuals are consequently threatened and harassed.” Id. at 2. But the Court cited no evidence that President Trump’s statements—as distinct from the statements of millions of others—caused such alleged threats or harassment, let alone that the statements were directed to inciting imminent lawless action.
According to Mediaite, Federal District Judge Tanya Chutkan looked into the details on Friday and temporarily stayed the gag order pending her ruling. This means that Trump has some relief as of this juncture, but things are subject to change as Trump speaks without a filter and mostly things go otherwise for him. The ruling by Federal District Judge Tanya Chutkan read the following:
Upon consideration of Defendant’s opposed 110 Motion for Stay Pending Appeal, Request for Temporary Administrative Stay, and Memorandum in Support, it is hereby ORDERED that the court’s 105 Opinion and Order is administratively STAYED to permit the parties’ briefing and the court’s consideration of Defendant’s Motion. It is FURTHER ORDERED that the government shall file any opposition to Defendant’s Motion by October 25, 2023, and that Defendant shall file any Reply by October 28, 2023. Signed by Judge Tanya S.
