Trump Facing Election Ban After Sad Loss In Court?

Donald Trump is fighting a hard fight in Colorado. The former president and Colorado GOP has received a word from Colorado District Judge Sarah Wallace which wouldn’t send across good vibes in the entire party.

 


 

Judge Wallace in three rulings on Friday took out the attempts by Trump and Colorado GOP to shutdown a lawsuit that blocks him from 2024 Presidential Ballot in the state. This ruling is based on the 14th Amendment’s “insurrectionist ban.”

The 14th Amendment’s “insurrectionist ban” based on the post-civil war confirms that anyone who takes the oath to uphold the constitution are barred from an office term if they are a part of the insurrection or supported/aided people behind the insurrection.

Citizens for Responsibility and Ethics in Washington is a liberal watchdog that has filed this case in Colorado. The judge is set to preside a trial in this regard on October 30th. The trial would confirm if the 14th amendment would apply to Trump. Wallace has shutdown many of Trump’s claims in a 24-page ruling.

If the Party, without any oversight, can choose its preferred candidate, then it could theoretically nominate anyone regardless of their age, citizenship, residency. Such an interpretation is absurd; the Constitution and its requirements for eligibility are not suggestions, left to the political parties to determine at their sole discretion.

Trump had called this a flawed case and asked for this case to be shutdown. Wallace however decided otherwise and even cited a 2012 opinion from Supreme Court Justice Neil Gorsuch. The Denver-based appeals judge stated that the states have the authority to “exclude from the ballot candidates who are constitutionally prohibited from assuming office.”

Donald called this a misuse of law and a state where lawsuits are pushing an “absurd conspiracy theory” and the challengers are “stretching the law beyond recognition.” In a statement released by Trump campaign on Saturday, and shared by CNN, Trump criticized the decision, and said the judge “got it wrong.”

She is going against the clear weight of legal authority. We are confident the rule of law will prevail, and this decision will be reversed – whether at the Colorado Supreme Court, or at the U.S. Supreme Court. To keep the leading candidate for President of the United States off the ballot is simply wrong and un-American.

It would be interesting to see how Trump responds to any opportunity that bars him from holding the position of power and his Presidential campaign.
