It has been noted that on Thursday, the Department of Justice decided not to prosecute Joe Biden over his retention of classified documents after his term as vice president based on a report from the Special Counsel in the case, ahead of his election against Donald Trump.
The report from Special Counsel Robert Hur recommended not to indict the former vice president, as per ABC News:
Special counsel Robert Hur said he will not recommend charges against President Joe Biden for his handling of classified documents while out of office, despite finding evidence that Biden “willfully retained” materials — capping a yearlong investigation that loomed over the 2024 presidential election.
“We conclude that no criminal charges are warranted in this matter,” said Hur’s report. “We would conclude the same even if there was no policy against charging a sitting president. Our investigation uncovered evidence that President Biden willfully retained and disclosed classified information after his vice presidency when he was a private citizen.”
Despite affirming that Biden “willfully retained” classified documents, Hur recommends not moving forward with charges. Testimony revealed Biden’s mental incapability.
On Twitter, one wrote: “When Biden was VP and took the documents he knew exactly what he was doing. Currently he is suffering from dementia and has been for some years. With the admittance of his current state of mind he should be removed from his position by means of #25thamendment”
Another wrote: “I think the democrats need to come clean about who is running this country”

“Hur’s report portrayed Biden as well-intentioned but sometimes hapless and forgetful, a man who had access to classified materials throughout his decades-long government career. The special counsel noted that Biden’s 2017 memoir ultimately did not contain classified information.
Prosecutors said that in their interviews with the president, Biden sometimes struggled to recall basic facts about his career and his life.
“He did not remember when he was vice president, forgetting on the first day of the interview when his term ended (‘if it was 2013 — when did I stop being Vice President?’), and forgetting on the second day of the interview when his term began (‘in 2009, am I still Vice President?’),” the report said.
The report recounts that Biden did not remember “even within several years” when his son Beau died. It says his memory appeared “hazy” in recounting even the debate over Afghanistan that “was once so important to him.”
The report offers the kind of detail that would add to the portrait of an aging, absent-minded president. Jurors, Hur wrote, could be “struck by the place where the Afghanistan documents were ultimately found in Mr. Biden’s Delaware home: in a badly damaged box in the garage, near a collapsed dog crate, a dog bed, a Zappos box, an empty bucket, a broken lamp wrapped with duct tape, potting soil, and synthetic firewood.”
