Former President Donald Trump’s attorney Alina Habba recently complained on Fox Business Network that she and former President Donald Trump are “not free” and are bound by a judge’s “gag order shackles” via Mediaite.
It has been noted that Judge Arthur Engoron’s narrow gag order prohibiting Trump from attacking the court’s staff — which was prompted by a Trump Truth Social post in which he attacked the judge’s principal law clerk — has already cost Trump $15,000.00 in fines and a threat of imprisonment from the judge.
However, that order was stayed pending an appeal — one which was resolved in Engoron’s favor two weeks ago when his gag order was reinstated. And this week, Trupm’s appeal of that ruling was also denied.
On Wednesday’s edition of Fox Business Network’s Kudlow, Habba and host Larry Kudlow complained — incorrectly — that the order violated the First Amendment, and Habba compared the order to “shackles”:
“LARRY KUDLOW: People should understand the Constitution, even if Jack Smith and Merrick Garland don’t. I mean, I would say that I’m not a lawyer. You’re the lawyer. But that’s the way I look at it. I’m free. Speech is not against the law. They’re stopping free speech downtown in New York or they did their best to. Does that case finally, this crazy real estate valuation case, which everyone has mocked now for months. Anybody in the business has mocked for months. Are you free of those shackles?
ALINA HABBA: No, I am not free of the gag order shackles.
LARRY KUDLOW: No–
ALINA HABBA: My First Amendment rights are definitely not, still being taken in some regard, and especially the Sixth Amendment right, right to a fair trial and litigation and being able to go there and make objections on this.
When I was in the courtroom, I couldn’t do it. Today was our last day outside of making closing arguments. Letitia James has concluded and we saw there that we had Deutsche Bank saying that the president and his company did nothing wrong. We had expert witnesses, a leading accounting expert, saying that there was absolutely nothing wrong with what they did, that their complaint lacked merit and unfortunately, we were dead upon arrival.
You have to remember, Larry, he he found fraud before we walked in the door. And the American people need to remember that. We just spent three months taxpayer dollars. And for what? I don’t know. I don’t know. It was a show so that Letitia James could get outside and do press conferences every day. It was a very expensive show.
