Rep. Clay Higgins (R-LA) recently said that Special Counsel Jack Smith’s “days are numbered” thanks to his prosecutions of former President Donald Trump via Mediaite.
Smith is prosecuting Trump in federal court in Florida over the former president’s retention of government documents after leaving office, and in Washington, D.C. for his attempt to overturn the 2020 election.
It has been noted that during an appearance on Newsmax on Wednesday, Higgins discussed a court filing by Smith seeking information about Trump’s Twitter account, some of which includes accounts that liked or retweeted his tweets.
Smith has only charged Trump a couple of associates in his inner circle, but that has not stopped conservatives from suggesting Smith is targeting ordinary Americans for nefarious purposes.
“So, let me say, regarding Jack Smith and his request for another list of American citizens under some alleged legitimate investigative effort,” Higgins said. “I consider it a badge of honor to be on another one of Jack Smith’s lists. So, I’ll just say that his days are numbered and American patriots are not gonna stand idly by, good sir, and allow our republic to dissolve. We are prepared to fight legally and peacefully and within the parameters of the Constitution with every ounce of our might and focus.”
As a prosecutor, Smith is not an elected official, so it is unclear what measures conservatives could take to “fight legally and peacefully” so that “his days are numbered.” Higgins has a history of incendiary rhetoric. In February, he ranted at ex-Twitter employees during a hearing and told them they will be arrested. In June, he called for an “insurrection” after one of Trump’s indictments. He later walked it back.
