Former President Donald Trump’s attorney, Alina Habba, expressed frustration on Fox News about the restrictions placed on Trump during the closing arguments of his fraud trial. The trial, led by New York Attorney General Letitia James and overseen by Judge Arthur Engoron, reached its conclusion on January 11, 2024. Trump’s legal team had requested a delay due to the recent death of his mother-in-law, but the judge denied the request.

Habba claimed that the judge’s refusal to postpone the trial was unreasonable, citing security concerns and the disruption caused by the Secret Service. She argued that taxpayer dollars had been wasted over the past three months and criticized the judge for requiring Trump to appear in court while his family was grieving.

Regarding the restrictions on Trump’s speech during the closing arguments, Habba asserted that the president, as a defendant, had the right to express his thoughts on the record. She accused the judge of imposing unnecessary limitations on Trump’s speech and claimed that the judge had previously issued a gag order on her and other lawyers involved in the case.

Habba argued that the judge’s restrictions went beyond the standard rules for closing arguments, preventing Trump from discussing certain aspects of the case. She claimed that the judge did not want Trump to address the “ugly parts” of the case and criticized the limitations on Trump’s free speech, both in court and on social media platforms.

Contrary to Habba’s complaints, Judge Engoron had offered to allow Trump to make a closing argument but with specific conditions. The judge required Trump to limit his speech to relevant, material facts presented during the trial, without introducing new evidence or delivering a campaign speech. The judge also prohibited Trump from impugning the court, plaintiff, or their staff. The offer aimed to ensure that Trump’s closing argument adhered to the standards applicable to counsel’s closing arguments in a legal proceeding.
